On the afternoon of October 14, 2022, a team led by Director Liu Yixing at Shanghai Landing Law Offices orchestrated a mock trial event. The simulated court proceeding revolved around a contentious equity transfer dispute, involving nearly a billion yuan, between a senior officer and their former listed company.
The mock trial court was graced by the presence of Shang Jiangan, a former senior judge of the Shanghai Intellectual Property Court and current Associate Professor at the School of Economic Law, Shanghai University of Political Science and Law, who presided over the trial. The tribunal also included two senior partners from Landing, Wu Bin and Ye Yunkai, serving as judges, with Legal Assistant Wang Qiyu acting as the court clerk. Associate Lin Yaochang and Legal Assistant Qin Peijia from the International Investment and Trade Department represented the plaintiff, while Associates Li Ying and Sun Lei from the Corporate Department defended the case. The client involved in this case was also invited to observe and participate as the plaintiff in this simulated courtroom scenario.
The mock trial mirrored the procedural rigors of a real court trial, with systematic progression from the plaintiff's statement, the defendant's defense, evidence presentation and cross-examination, to court debates and the panel's final judgment. The entire trial spanned nearly four hours, with the attorneys representing both plaintiff and defendant thoroughly arguing the contentious points. Following the trial, all parties and panel members engaged in a deep-dive discussion on the case, offering their perspectives from various angles. A/Prof. Shang Jiangan highlighted the key issues of the case from a judge's viewpoint and proposed many constructive suggestions for refining litigation strategies. Drawing on their years of practical experience, Wu Bin and Ye Yunkai offered professional advice on multiple aspects, including evidence and strategic planning. The observing attorneys also actively participated in the discussion, expressing their views in alignment with their own professional expertise.
The participants in this mock trial were former judges and senior practicing attorneys with a wealth of practical experience. The simulation of complex cases through mock trials not only consolidates multi-party efforts and facilitates comprehensive case discussions, but also enables pre-emptive case trajectory predictions.
