Landing Law Offices Organizes a Symposium on the Jurisdictional Issues of Financial Crimes with Renowned Experts

On June 21, 2023, Landing Corporate Risk Control Team successfully hosted a symposium on the jurisdictional issues of financial crimes in Zhongguancun, Beijing. The conference invited esteemed professors from Peking University: Professor Chen Xingliang and Professor Wang Xin; from Tsinghua University: Professor Zhang Jianwei and Professor Li Hong; and from the Central University of Finance and Economics: Professor Xing Huiqiang. These experts deeply discussed the cross-regional jurisdictional challenges often found in financial crime cases.

 

Financial crime cases often involve multiple jurisdictions, leading to situations where multiple judicial authorities intervene either sequentially or simultaneously. Disputes and deflections among these judicial entities are not rare, especially on jurisdictional matters. This leads to challenges in following the provisions of the Criminal Procedure Law, resulting in outcomes that deviate from the principles of the Criminal Law.

 

Professors Chen Xingliang, Wang Xin, and Li Hong shared views from a criminal law perspective, discussing concepts like concurrent punishment for multiple offenses. Professor Zhang Jianwei elaborated on the idea of not splitting continuous crimes from the vantage of criminal procedural law. Professor Xing Huiqiang approached the subject from a financial law angle, emphasizing the accurate determination of transaction amounts in complex multi-account transactions.

 

Lawyers from Shanghai Landing Law Offices – Ding Yanling, Wang Jun, and Pu Guiping – also contributed by sharing insights based on their practical experiences.

 

Throughout the two-hour discussion, the five professors presented specific views and suggestions on how to fairly and legally manage and coordinate the jurisdiction of cases, which would actively guide the protection of the legitimate rights and interests of the parties involved.

 

This symposium delved into cutting-edge solutions to the jurisdictional challenges in financial crime cases, fostering better legal harmonization and protection of rights in practice. We believe that through such symposiums, we can better address jurisdictional issues in financial crimes, ensuring both procedural and substantive justice, and fully reflecting fairness and justice in judicial practice.
