The 2023 Customs Law Annual Conference of the Customs Law Research Institute of Shanghai Law Society and the 16th Customs Law Forum was held in Qinhuangdao City from Jul. 21 to 22, 2023. With the theme of “Chinese-style of Modernization and Customs Law Practice”, this forum was hosted by the Customs Law Research Institute of Shanghai Law Society and co-organized by the Customs Law Research Center of Chinese Academy of Customs Administration. The forum was conducted in a hybrid mode, both online and on-site, with the participation of more than 200 representatives from different industries such as the Customs, colleges and universities, industry associations, research institutes, justice institutes, law firms and enterprises. Mr. FENG Haibin, senior partner of LANDING Shenzhen, was invited to attend the forum and share his views.
Under the chairmanship of Prof. CHEN Hui, President of Chinese Academy of Customs Administration and former Vice President of Shanghai Customs College, the Customs Law Forum has been held for sixteen consecutive years, which has become an annual event for the academia and practical field of customs law in China. This year’s forum mainly focuses on five sectors: Chinese-Style Modernization and the Rule of Law in Customs, National Security and Operator Compliance, Digital Customs for a Powerful Nation, Import and Export Taxation and Customs Supervision System, and Research on Customs Criminal Law Issues.
In the sector of “Research on Customs Criminal Law Issues”, LANDING senior partner Mr. FENG Haibin delivered a speech titled “Improvement for the Convergence of Administrative Law and Criminal Law in Customs Legal Practice Path -- Taking the Case of Recovering the Equivalent Value of Smuggled Goods after Not being Prosecuted as an Example”. From the perspective of legal practice, combining with his own practice experience and examples, Mr. Feng summarized the issue of the convergence between non-prosecuted smuggling criminal cases and customs administrative penalty, and proposed solutions and suggestions.
