She delivered a presentation titled "Phenomenal Issues and Regulatory Principles Triggered by ChatGPT." Centered around the keywords "innovation," "emergence," and "boundaries," Ms. Chen shared her learning and reflections since the explosion of ChatGPT. Starting with the question "Is ChatGPT just?" she delved into topics including global innovation, industrial emergence, societal impact, and compliance principles related to ChatGPT, offering her insights. While acknowledging that "ChatGPT is open to everyone, and we cannot stop progress," she stressed the need to regulate progress collaboratively through legal, societal, and corporate efforts.
Following this, Lawyer Zhao Tianjiao from Shanghai Landing Law Offices and Co-Initiator of Landing's Metaverse Project presented a professional analysis on the topic "Evolution of Generative Artificial Intelligence (AIGC) Technology and Ethical Norms." In the one-month period from the initial planning to the event, Zhao witnessed the accelerated development in the field of artificial intelligence, even the shift from AIGC to AGI (Artificial General Intelligence) trends. Various AIGC applications have sprung up across China, but policies, regulations, and technical standards are still being established. Given the considerable uncertainties in regulatory compliance from research and development to application scenarios, Zhao provided analyses and suggestions from multiple perspectives including regulatory legislation, corporate compliance, and professional institution services. He also introduced the "Landing AI Compliance," Landing's first solution tailored to the legal compliance of AI products.
Next, Lawyer Chen Mengyuan from Shanghai Landing Law Offices, holding a patent agent qualification, shared insights on "Regulating Artificial Intelligence Algorithms from the Perspective of Online Infringement." Chen first summarized the regulatory policies for AI algorithms distributed among various regulations before the implementation of the "Internet Information Service Algorithm Recommendation Management Regulations." Combining cases like the "first instance of big data discrimination" case, the "first instance of recommendation algorithm" case, and the "accomplice AI personality rights infringement" case, Chen explored the court's standards for determining algorithm infringement and the definition of algorithm "technological neutrality" in the context of existing cases.
Lastly, Lawyer Wang Ren, a member of the Shanghai Lawyers Association Criminal Compliance Committee, shared insights on "Criminal Risks and Responses in the Field of AIGC Data Acquisition." As a professional criminal lawyer, Wang combined practical judicial cases related to data to introduce various criminal risks that the field of artificial intelligence might encounter, including data-related crimes, privacy-related crimes, copyright and trade secret-related crimes, etc. For each criminal risk, he offered compliance suggestions related to data system, copyright protection, privacy protection, and platform content audit system establishment, based on practical experience.
