Shanghai Landing Successfully Hosts "Legal Risks in the Medical Aesthetics Industry" Seminar

On the afternoon of April 12, 2023, the first themed sharing event of Landing's Life Sciences and Medical Health Professional Group, titled "Legal Risks in the Medical Aesthetics Industry," was successfully held at Landing's global headquarters in the Equality Meeting Room. The seminar was presented by Lawyer He Chunfeng, Senior Partner at Shanghai Landing Law Offices, and moderated by Senior Partner Lawyer Ji Ming. The event took the form of both an online live stream and offline participation.

 

To begin the seminar, Moderator Ji Ming provided an overview of sub-industries within the field of life sciences and medical health from a commercial and industry perspective. He then briefly summarized the main legal service types involved in the operations of medical institutions, pharmaceutical enterprises, and medical device companies, such as compliance systems, product trade licenses, transaction models, and dispute resolution. This approach helped the audience gain a comprehensive understanding of the types of legal services and work content within the field of life sciences and medical health from a macro and framework perspective.

 

Subsequently, the main speaker of the seminar, Lawyer He Chunfeng, started with the nature of medical aesthetics and the current state of the medical aesthetics industry. He primarily focused on three aspects: the qualifications of medical aesthetics institutions, operational risks, and handling disputes in the medical aesthetics sector. Lawyer He mentioned that the current regulatory policies in the medical aesthetics industry have become more stringent with significant policy changes. Over the past five years, there have been over 20,000 judgments related to "medical aesthetics" cases. Furthermore, the regulation of the medical aesthetics industry has become increasingly complex, involving aspects such as medical services, drug injections, the use of medical devices, and medical advertising. Addressing the issues faced by medical aesthetics institutions, Lawyer He suggested enhancing compliance from various angles including qualifications, advertising, disclosure processes, product control, and medical record writing. For individuals seeking aesthetic procedures, Lawyer He advised safeguarding their own rights by considering qualification reviews, evidence collection, and case selection. Finally, Lawyer He used case comparisons to illustrate how identical situations in practice can yield different appraisal results due to different appraisal institutions, ultimately leading to variations in compensation amounts, sometimes differing by hundreds of thousands.

 

As an on-site commentator, Senior Partner Sun Yun expressed that the content of this seminar provided valuable insights. It deepened her understanding of regulations and dispute resolution in the medical health industry, particularly the field of medical aesthetics. Additionally, Sun Lawyer shared her own experience gained from providing training to large corporations for many years. She emphasized that a profound understanding of the pharmaceutical industry, coupled with a wealth of industry information and experience, is essential to provide accurate and effective legal services to clients in this field.
