During the period from November 28 to December 14, 2023, the Digital Economy team of Shanghai Landing Law Offices organized a series of seminars on the theme of "Embracing Proactively or Being Passively Eliminated in the Digital Economy Era".

 

The series of seminars consisted of six sessions, featuring not only the insights from professional lawyers in the Digital Economy team, but also discussions with industry experts in relevant fields, founders of other renowned law firms, and legal professionals.

 

01 Session One: Regulatory and Compliance of AIGC

 

On November 28 at 7 p.m., lawyers Ye Juan and Chen Mengyuan invited NETEASE YIDUN AIGC technical expert Ma Ruochen to share insights on "Regulatory and Compliance of AIGC." The three speakers approached the topic from legal, industry, and international perspectives, analyzing AIGC's regulatory system and practical cases to dissect content safety issues facing the pan-entertainment industry. They delved into AIGC's technology applications, related risks, regulatory challenges, and compliance essentials. Lawyer Chen Mengyuan provided recommendations for addressing legal risks when using AIGC within an enterprise, while expert Ma Ruochen assessed future trends in content risk control technology, emphasizing AIGC's effectiveness in enhancing enterprise content risk control capabilities.

 

02 Session Two: Current Criminal Risks in Virtual Currency Trading

 

On December 1 at 7 p.m., lawyers Sun Jun, Ding Yanling, and Wang Ren discussed the "Criminal Risks of Current Virtual Currency Trading." They focused on the keyword "virtual currency" and analyzed the risks related to projects, exchanges, and merchants. They also explored the highly anticipated topics of "mining" and "trading coins." Lawyer Sun Jun linked the significant event in the coin circle of "Binance CEO Zhao Changpeng's resignation and a $4 billion settlement with the United States," analyzing the ecosystem and content of the coin circle and elaborating on the development and current situation of virtual currency in China. Lawyer Wang Ren systematically introduced the hidden money laundering risks in current virtual currency transactions from the perspective of potential criminal risks associated with virtual currency, and analyzed the current anti-money laundering policies in China. Lawyer Ding Yanling, based on criminal cases closely related to virtual currency, provided a detailed interpretation of the crime of money laundering and the crime of helping information network activities related to virtual currency transactions. Additionally, the three lawyers compared and summarized the attitudes and policies of developed countries in both domestic and international communities towards virtual currency.

 

03 Session Three: Insights into Cryptocurrency in Hong Kong

 

On December 5 at 7 p.m., YTL LLP lawyers Liang Yanda and Xia Jiaxi, along with Landing lawyer Xiong Yajie, freely discussed "Insights into Cryptocurrency in Hong Kong" with the audience. Based on current regulations and policies related to cryptocurrency in Hong Kong, they deeply analyzed the regulatory points of trading platforms and explained the differences between tokenized securities and digital securities. They also differentiated and summarized the trading modes of cryptocurrencies under the current development situation, sharing practical case studies. Building on this foundation, the three lawyers systematically and comprehensively analyzed the challenges and compliance requirements of the cryptocurrency trading market in Hong Kong.

 

04 Session Four: Practical Cases of Enterprise Data Compliance System Construction

On December 7 at 7 p.m., lawyers Zhang Li, Zhao Tianjiao, and Landing (Guangzhou)'s senior partner Kong Yunfei delved into the key points, pain points, and bottlenecks of constructing enterprise data compliance systems through practical case studies. Drawing from their practical experiences, the lawyers systematically analyzed the overall status of enterprise data compliance, highlighting industries in urgent need of such compliance and typical applicable scenarios. They summarized the key requirements of enterprise data compliance based on current domestic regulatory demands and judicial cases, and provided detailed analyses on resolving common issues encountered in internal enterprise data compliance work. Finally, they summarized special considerations for cross-border compliance and forecasted the development trends of domestic data compliance in 2023.

 

05 Session Five: Why is Business Secret Protection Urgent in the Digital Economic Era?

 

On December 12 at 7 p.m., lawyers Li Rong and Ye Juan conversed on "Why is Business Secret Protection Urgent in the Digital Economic Era?" Lawyer Li Rong interpreted current regulations on the protection of business secrets in China through practical case studies, emphasizing why enterprises should prioritize business secret protection. Lawyer Ye Juan detailed potential scenarios of business secret leakage in the contexts of personnel mobility, external cooperation, and lack of effective protective measures, offering strategies and suggestions for protecting business secrets. Additionally, they announced the upcoming internal testing of a business secret evaluation app jointly developed by the two lawyers.

 

06 Session Six: Legal Professionals, Surfing WEB3.0!

 

On December 14 at 7 p.m., lawyer Ding Xueming and Shanghai Mankun Law Firm founder Liu Honglin focused on "Legal Professionals, Surfing WEB3.0!" Liu Honglin expounded on his reasons for choosing the niche field of WEB3.0 based on his entrepreneurial experience, and discussed the opportunities that WEB3.0 brings to legal professionals. He also analyzed whether virtual currency investments and trading could provide opportunities for legal professionals in the future. During their discussion, Ding Xueming raised concerns about young lawyers' pursuit of specialized paths, to which Liu Honglin advised them to seize "opportunities of the times," integrate "social value" and "economic benefits," and adopt a "racehorse" approach. Lastly, the two lawyers provided candid and constructive career development advice for young lawyers in the fiercely competitive legal service market.

 

The successful organization of the first themed series of lectures by the digital economic team provided participants with a deeper understanding of the issues behind the digital economy. The next themed series of lectures is currently in preparation, so please stay tuned!
